Pricing and Billing
LA Tutors 123 offers varying rates for private tutoring and admissions consulting services. All packages are prepaid and non-refundable. Tutoring hours don’t expire and are transferable to any family members or friends. Our packages are designed to encourage consistency and maximize the positive results of the tutorial sessions. The client agrees to authorize LA Tutors 123 to charge the balance IN FULL for the selected package to the credit card provided, immediately upon signing up for our services. The client shall not pay the tutor or admissions consultant directly. All payments from the client must be directed to and delivered to LA Tutors 123. In addition, all client referrals must be directed to LA Tutors 123 before services can be rendered to the referred client.
Cancellations
LA Tutors 123 enforces a strict 24-hour cancellation policy for all scheduled sessions. You must give your tutor or admissions consultant 24 hours advance notice to cancel or reschedule an appointment. Appointments cancelled less than 24 hours before the session will be billed as if they had occurred. Additionally, you are responsible for arriving on time to your scheduled sessions (if not meeting at home); otherwise, the wait time will be counted as part of the tutoring time. Small group class cancellations must be made and confirmed by all attending students 24 hours in advance. Missing students will be billed for any class that is held.
Program Payment
You must pay in full at the time of enrollment. If you have not paid in full by the first scheduled session, you authorize LA Tutors 123 to charge the package total to the payment method on file.
Lost Materials
If you lose your program materials, replacement books will not be provided for free. You may either purchase a replacement book from a 3rd party or purchase the materials from LA Tutors 123.
Hours vs Sessions
Please note that session lengths vary; the number of hours you have purchased does not necessarily correspond to the number of sessions you will have. LA Tutors 123 does not refund unused hours.
Payment for Additional Tutoring Hours
If you complete more hours than the number for which you initially enrolled, you authorize LA Tutors 123 to charge your payment method on file for any additional hours you have used at the non-discounted applicable rate for the services. Without limiting the foregoing, additional hours will not be eligible for any discount, promotion or rebate. Speak regularly with your tutor and/or admissions consultant throughout the process so you know how many hours you have completed.
Adult Supervision
Please note that LA Tutors 123 tutors and admissions consultants are not permitted to meet in person with a minor student in a private home unless a parent or guardian is present (on-site) during the entire session. If a tutor or admissions consultant arrives for a session and such an adult is not present, the sessions may not continue. The session will be considered cancelled by the student without adequate notice, and you will be charged under our cancellation policy because the session was effectively cancelled without 24 hours advance notice. If the parent or guardian leaves in the middle of a session, the tutor and/or admissions consultant will also leave at that time, and you will be charged for the entire session. If a session is taking place in a room, the door must remain open and unlocked at all times. Tutors and admisions consultants may also meet in person with minor students in public locations, such as a library or coffee shop, when the parent or guardian is present. The adult supervision requirement does not apply to students who are eighteen (18) years or older.
COVID-19 Policy
Students and tutor are recommended to wear face coverings at all times during the in-person tutoring session. Safe physical distancing (i.e. separation by at least 6 feet) should be kept whenever possible. Tutors will screen students at the start of every session by asking if they are experiencing COVID symptoms. If either students or tutor test positive for COVID, in-person lessons may not resume until person(s) are fever free and asymptomatic for 24 hours in addition to testing negative for COVID with two sequential tests 48 hours apart.
Tutor Satisfaction Guarantee
We are committed to 100% client satisfaction. If for any reason you are not happy with the tutor we have assigned to you, please contact LA Tutors 123 within 24 hours of the tutorial session. We will assign a new tutor and credit your account for the first hour of your first session with your original tutor. If you request a different tutor more than 24 hours after the tutorial session, the original session will be charged in full.
Guaranteed Results Guarantee
If you enroll in a test prep course with LA Tutors 123, and the student’s score does not improve, you are eligible to receive a credit in full for the hours purchased. These hours may only be used for the same student and subject material as the original course. To be eligible, you must also meet the following requirements:
- Student must attend all of the tutoring sessions, take all assigned practice tests, and complete all of their homework.
- Student must take the official test for which they prepared on the next official test date following the final session of their program.
- Student or Parent/Legal Guardian present the student’s official test score report(s) to us and request the credit within fifteen (15) days after the official test scores are released.
HOW WE MEASURE IMPROVEMENT:
For purposes of measuring improvement for the above Guaranteed Results Guarantee, we consider an official test score to be your total SAT score (Math and Evidence-Based Reading and Writing combined), your composite ACT score, your total PSAT score, your SAT Subject Test score, the sum of your ISEE stanines, the total percent correct on your HSPT, your total CHSPE score (sum of English/Language Arts and Mathematics), your total GED score (Science, Math, Social Studies, Writing, and Reading combined), your total GRE score (Verbal and Quantitative combined), your total GMAT score (out of 800), your total CSET score(sum of all three subtests), your individual CSET subtest score, your total CBEST score (Reading, Math, and Writing combined), your total TOEFL score (Reading, Listening, Speaking, and Writing combined), or your total ASVAB score (AFQT score) as applicable.
If the student takes an official test six months or less before the start of their LA Tutors 123 program, we will compare the prior official test score to the official score on the test the student takes on the next official test date following the final session of their program.
If the student has not taken an official test six months or less before the start of their LA Tutors 123 program, we will compare the results of their first practice test in our program to their score on the official test they take on the next official test date following the final session of their program.
The Guaranteed Results Guarantee may only be used once for each test prep course purchased.
Arbitration & Class/Collective Action Waiver
Any and all disputes arising out of or relating to these Terms and Conditions, other than disputes relating to intellectual property infringement, including whether the dispute is arbitrable and the scope of this arbitration agreement, shall be finally resolved by arbitration administered by a single arbitrator under the then-applicable commercial rules of the American Arbitration Association (AAA) in accordance the Federal Arbitration Act (FAA). The arbitration shall be governed by and construed by federal law to the fullest extent possible. Unless otherwise agreed by the parties, the arbitration shall take place in Los Angeles, California. Judgment on the arbitral award may be entered in any court having jurisdiction thereof. The applicable statute of limitations will apply to all claims raised in any arbitration demand. Failure to demand arbitration within the prescribed statutory limitation period shall result in waiver of said claims.
To the maximum extent permitted by law, should you wish to initiate an arbitration action against LA Tutors 123, you will not assert class, collective, or representative action claims against LA Tutors 123. The same applies to any arbitration action by LA Tutors 123’s against you. Thus, you and LA Tutors 123 agree that each may submit only their own individual claims in arbitration and will not seek to represent the interest of any other person through a class, collective or representative action in court or arbitration or other forum. Further, unless both you and LA Tutors 123 agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over a representative or class proceeding.
Waiver of Liability and Hold Harmless Agreement
In consideration for you/your child being permitted to receive private tutoring sessions from LA Tutors 123, you agree to hereby release, waive, discharge, and covenant not to sue LA Tutors 123, its parents, subsidiaries or other affiliates, officers, agents, tutors, or employees (hereinafter referred to as “Releasees”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or any of the property belonging to you, whether caused by the negligence of the Releasees or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted. You further hereby agree to indemnify and hold harmless the Releasees from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to your participation in said activity, whether caused by the negligence of Releasees or otherwise. It is your express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representative, if you are deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named Releasees.
You understand that you may later discover claims or facts that may be different than, or in addition to, those which you now know or believe to exist with regards to the subject matter of this Agreement, and which, if known at the time of signing this release, may have materially affected this Agreement or my decision to enter into it. Nevertheless, you hereby waive any right or claim that might arise as a result of such different or additional claims or facts. YOU HAVE BEEN MADE AWARE OF, AND UNDERSTAND, THE PROVISIONS OF CALIFORNIA CIVIL CODE SECTION 1542 AND HEREBY EXPRESSLY WAIVE ANY AND ALL RIGHTS, BENEFITS AND PROTECTIONS OF THAT STATUTE, WHICH PROVIDES: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” Cal. Civ. Code §1542.
You hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of California. You warrant and assure that you are at least 18 years of age and fully competent. You acknowledge that the above constitutes the whole of our waiver of liability and hold harmless agreement, and that no additional claims or representations have been made.
Non-Solicitation Agreement
By becoming a LA Tutors customer, you agree that you will not solicit for employment, hire, or permit any organization directly or indirectly controlled by you to solicit for employment or hire any personnel of LA Tutors at any time during the term of LA Tutors’ provision of services to you and for a period of one (1) year thereafter. Breaks
Any single tutoring sessions which meets for 3 consecutive hours or more must include a paid 10 minute rest break.
Miscellaneous
These Terms and Conditions supersede all prior oral or written agreements, if any, between the parties and constitutes the entire agreement between the parties. The agreement cannot be changed or modified orally. Any change or modification must be in writing and agreed to by both parties. If any provision of these Terms is found to be unenforceable for any reason, such provision shall be construed by limiting it to make it enforceable to the maximum extent permitted by law, and the remainder of the Terms shall continue in full force and effect.
Acceptance of These Terms and Conditions
I understand that by signing above and submitting this form, I acknowledge that (1)I have read and that I agree to these enrollment terms and conditions, (2)I understand that LA Tutors 123 does not guarantee acceptance to any school or a passing score on any exam. You must be 18 years of age or older to accept these terms and conditions. If you are less than 18 years of age, you must have a parent or guardian accept on your behalf. Checking the “I Agree” checkbox is a representation from you that you are at least 18 years of age.
